1. About these terms
These terms are a contract between you and Cinema Priority ("we", "us") for the use of cinemapriority.co.uk and our membership alert service. By creating an account or using the site you agree to them. Please also read our privacy policy, which explains how we handle your personal data. 2. The service
Cinema Priority is a digital information service. We watch publicly available ticket inventory for IMAX 70mm screenings and send members alerts about restocks and new showtimes. We do not sell, resell or hold tickets and we never handle your ticket purchase: you buy directly from the cinema at its retail price. We are not affiliated with or endorsed by IMAX Corporation, any film studio or any cinema operator.
3. Your account
You must be at least 18 to create an account, because memberships are paid subscriptions. Keep your login details secure and the information on your account accurate. Your account is personal to you: one account per person and you must not share access to it. Tell us straight away if you think someone else has used your account.
4. Memberships, tiers and pricing
We offer a Free tier and paid tiers. Your tier sets your alert refresh speed, your monthly alert allowance, the locations you can cover and any extras, as described on the pricing page. The price and currency that apply to you are shown at checkout. We may change tiers, allowances or prices from time to time. If a change affects your paid membership we will give you reasonable notice by email or in your account and you can cancel before it takes effect.
5. Payment
Paid memberships are billed monthly in advance through our payment provider, Stripe. Your card details go directly to Stripe and are never stored by us. If a renewal payment fails we may retry it and suspend your paid benefits while we do. If it still fails your account moves to Free and to regain a paid tier you may need to take out a new membership. You can manage your billing and cancel at any time from your account via the Stripe customer portal and upgrade or change tier from your account page.
6. Your right to cancel
If you are a consumer you have a legal right to change your mind within 14 days of first taking out a paid membership or upgrading to a new tier. Your membership is a digital service that starts as soon as you subscribe. By subscribing you expressly request immediate access and acknowledge that, to the extent your membership is treated as digital content, you lose the right to cancel once access begins. Where the right applies and you cancel within those 14 days, you will pay a proportionate amount for the time you had access and we will refund the rest. To exercise this right, cancel from your account or send us any clear statement that you wish to cancel; you may use the model cancellation form in the Consumer Contracts Regulations 2013 but you do not have to.
Outside the 14-day period you can still cancel at any time. Your paid benefits continue until the end of the period you have paid for and your account then moves to Free. We do not otherwise give refunds for partly used billing periods and this does not affect your statutory rights.
7. Alerts and ticket availability
Alerts depend on publicly available inventory signals from cinemas and ticketing systems, which can change, break or be withdrawn without warning. We will provide the service with reasonable care and skill, but we cannot promise that every restock will be caught, that alerts will always arrive within a particular time or that tickets will still be available when you receive an alert. Always complete your purchase through official cinema channels.
8. Acceptable use
You must not:
- share, resell or otherwise commercialise your access, your alerts or member-only materials;
- scrape, copy or extract data from the service or access it by automated means other than the features we provide;
- interfere with the operation or security of the service or attempt to gain access to accounts or systems you are not authorised to use;
- use the service to break the law or to breach the terms of any cinema or ticketing platform;
- use alerts to buy tickets for resale above retail price.
9. Members' community
Active members may be invited to our community on Discord. Discord is a separate service with its own terms and privacy policy. Behave respectfully; we may remove anyone from the community who abuses it or breaches these terms.
10. Intellectual property
The site, its branding and its content belong to us or our licensors and you may not reuse them without our permission, except as allowed by law. IMAX is a registered trade mark of IMAX Corporation and film titles and artwork belong to their respective owners. We refer to them only to describe what our alerts cover.
11. Suspension and termination
We may suspend or close your account immediately and without refund if you seriously or repeatedly breach these terms, including the acceptable use rules in section 8. If we close your account or withdraw the service for any other reason, we will give you reasonable notice and refund the unused part of any period you have paid for.
12. Our liability to you
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or for anything else that cannot be excluded or limited under English law.
We are not responsible for tickets you were unable to buy, for screenings selling out, for the decisions of cinemas or ticketing platforms or for losses that were not a foreseeable result of our breaking these terms. We are not liable for business losses; the service is for personal use only. Otherwise, if you have a paid membership our total liability to you in connection with the service is limited to one month of your membership fee at your current tier or £100, whichever is lower. If you use the free tier our total liability to you is limited to £10.
13. Your statutory rights
If you are a consumer, you have rights under the Consumer Rights Act 2015, including that the service must be provided with reasonable care and skill and match its description. Nothing in these terms takes away rights the law gives you that cannot be excluded.
14. Changes to these terms
We may update these terms, for example to reflect changes in the service or the law. For significant changes we will give you notice by email or in your account before they take effect and if you do not agree you can cancel your membership. The date at the top shows when these terms last changed.
15. General
If a court finds part of these terms unenforceable, the rest remains in force. If we delay enforcing any part of these terms, we can still enforce it later. We may transfer this contract to a business that takes over the service and will tell you if we do; you need our written consent to transfer your rights to someone else. These terms do not give any rights to anyone who is not party to them.
16. Governing law and disputes
These terms are governed by the laws of England and Wales. If you have a problem, contact us first at privacy@cinemapriority.co.uk and we will try to put it right. We are not obliged to use and do not currently use an alternative dispute resolution provider. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland you can also bring proceedings in the Scottish courts and if you live in Northern Ireland, in the courts of Northern Ireland; you also benefit from any mandatory rules of the law where you live.
